4. REGULATORY REQUIREMENTS. The offeror/contractor is encouraged to use recovered materials to the maximum extent practicable, in accordance with paragraph 23.403 of the Federal Acquisition
Regulation (FAR).
5. PRODUCT CONFORMANCE
5.1 Product conformance. The products provided shall meet the salient characteristics of this Commercial
Item Description, shall conform to the producer's own drawings, specifications, standards and quality
assurance practices, and be the same product offered for sale in the commercial marketplace for over one year, or is the same product that has successfully been delivered to the Government on a previous contract or purchase order. The Government reserves the right to require proof of such conformance prior to first delivery and thereafter as may be otherwise provided for under the provisions of the contract.
5.1.1 Market acceptability criteria. The following market acceptability criteria are necessary to document the quality of the product to be provided under this CID.
a. The company producing the item must have been producing a product meeting the requirements of this CID for at least 2 years.
b. The company must have sold at least1000 units of the product meeting the requirements of this
CID, in the commercial or government marketplace over the past 2 years.
5.2 NSF International standard compliance. (For type IV, grade B only). Prior to the approval of the first shipment, the contractor shall submit satisfactory evidence to the contracting officer or his authorized representative that the items conform to the applicable requirements of NSF/ANSI Standard No. 2, or NSF/ANSI Standard No. 169. Acceptable evidence of meeting the requirements of NSF/ANSI Standard No. 2, or NSF Standard No. 169 shall be a listing in the current edition of the
NSF International "Listing of Food Service Equipment" and display of the NSF International mark on the finished can opener, or certified test report from a recognized independent testing laboratory acceptable to the medical authority of the service for which the items are being procured stating that the items have been tested and conform to NSF/ANSI Standard No. 2, or NSF Standard No. 169. Acceptance of the independent testing laboratory to the medical authority shall be based on the laboratory submitting to the contracting officer a written letter from either the American Association for Laboratory Accreditation (A2LA), Gaithersburg, MD, or the American National Institute (ANSI), Washington, DC, stating that the independent testing laboratory has been evaluated and is accredited for testing and evaluating food service equipment for conformance with applicable NSF International standards and criteria. Accreditation of the independent testing laboratory must be completed prior to the item testing.
5.3 Load and performance test. All cans specified in the following paragraphs shall comply with PPP-C-
96.
5.3.1 Type I, class 1 opener. The opener handle shall be clamped in a holding device at a 45- degree angle from the horizontal. The opener shall be used to open nine No. 10 round cans. The opener shall then be examined to determine compliance with the parts separation, breaking, and permanent deformation requirements of 3.1.1.
